Susan Franck ’89 Authors Book on Investment Arbitration

Susan Franck ’89 authors Arbitration Costs: Myth and Realities in Investment Arbitration  (Oxford University Press). It offers a nuanced analysis of how and when cost-shifting occurs, parses tribunals’ rationalization of cost assessments, and models the variables most likely to predict costs, using data to point the way towards evidence-based normative reform. The text is central to core debates at the U.N., E.U., and World Bank about the future of investment treaty dispute settlement. The book launch was held at the World Bank International Centre for the Settlement of Investment Disputes and included a panel discussion with Susan.

“I owe much to Simon's Rock and its focus on interdisciplinary thinking,” says Susan. “...that helped foster my approach to scholarship.” She notes that she used the research methodologies she learned at Simon’s Rock to integrate psychology concepts into current debates about international investment law and dispute settlement through arbitration.
